“Under the Freedom of Information act can you please provide the following information in respect of Ordnance Survey:

  1. The name, position and contact details (telephone number and email address) of the person responsible for arranging and administering the organisations insurances.
  2. Which classes of commercial insurance do the organisation currently procure?
  3. When are these policies due for renewal?
  4. How much does the Authority spend annually on its insurance premium?
  5. Please confirm the name of the organisation’s current insurance broker/advisor (if applicable).
  6. When was the contract for insurance broking services last reviewed/tendered?
  7. What method was used to procure the organisations broker services, ie Contract Notice in Find a Tender Service, CCS Framework, YPO Framework, open market tender etc.
  8. When will the current contract for insurance brokerage services expire?
  9. Is this subject to a potential extension?”

Our response

I confirm that Ordnance Survey does hold some of the information you have requested. Where the information is exempt from disclosure this is stated.

Taking each request in turn, I confirm the following:

1. The name, position and contact details (telephone number and email address) of the person responsible for arranging and administering the organisations insurances

The position of the person responsible for OS insurance contracts is the Procurement and Contract Manager.

The information relating to the name and direct contact details, is held by OS but is exempt from disclosure under section 40(2) (personal information) of the FOIA, as the information constitutes personal data.

Section 40(2) provides that personal data is exempt information if one of the conditions set out in section 40(3) is satisfied. In our view, disclosure of this information would breach the data protection principles contained in the General Data Protection Regulations and Data Protection Act 2018

In reaching this decision, we have particularly considered:

  • the reasonable expectations of the employees: given their positions, OS considered that none of the individuals would have a reasonable expectation that their personal data would be disclosed;
  • the consequences of disclosure; and
  • any legitimate public interest in disclosure.

Section 40(2) is an absolute exemption and therefore not subject to the public interest test.

01 April 2024 for the classes referred to above except: 1 May 2024 for D&O Management Liability; and 18 August 2024 for Environmental Liability.

4. How much does the Authority spend annually on its insurance premium?

£522,566.14.

December 2021.

Internal review

The Internal Review Officer will not have been involved in the original decision.
